These terms govern the use of the digital business process platform of Kalamata Transactions GmbH. By registering and using the platform, you accept the following provisions.
The platform provides companies with tools for the digitalization and automation of business processes, particularly in the areas of digital transactions, invoicing, and order processing. The offered services include the electronic capture, processing, and archiving of business documents, as well as integration into existing ERP systems. Use for private, non-commercial purposes is excluded.
Using the platform requires registration with complete and correct company data. You are obligated to treat your access data confidentially and to inform us immediately of any unauthorized use of your account. Kalamata Transactions GmbH is not liable for damages arising from the misuse of your access data if you have violated your duty of care.
You undertake to use the platform only within the framework of applicable laws and these terms. In particular, it is prohibited to use the platform for fraudulent, misleading, or illegal activities, including money laundering, unauthorized financial services, or the processing of data from gambling. You ensure that all data and documents uploaded by you have been lawfully acquired and do not infringe any third-party rights.
The processing of personal data is carried out in accordance with our privacy policy and the requirements of the GDPR. We take appropriate technical and organizational measures to protect your data from unauthorized access, loss, or misuse. You are responsible for ensuring that the data you provide complies with data protection requirements.
Kalamata Transactions GmbH is fully liable for intent and gross negligence, as well as for injury to life, limb, and health. For simple negligence, we are liable only for the breach of essential contractual obligations (cardinal obligations), limited to the typically foreseeable damage. Liability for indirect damages, lost profits, or data loss is excluded to the extent permitted by law.
We strive to provide the platform with an availability of at least 99.5% on an annual average. For planned maintenance work, we will inform you in good time by email or via the platform. Excluded from availability are periods during which the platform is inaccessible due to force majeure, external attacks, or necessary security updates. There is no entitlement to a specific level of availability.
We reserve the right to change these terms of use at any time with effect for the future. We will inform you of material changes by email at least four weeks before they take effect. If you do not object to the change within two weeks of receiving the notification, the new terms will be deemed accepted by you. In your objection, we will specifically draw your attention to this deadline and the legal consequences.
You may terminate the use of the platform at any time without stating reasons by deleting your account via the settings or by contacting us by email. We may terminate the use with extraordinary effect if you breach essential obligations under these terms, particularly in the event of violations of Section 3. After termination, your data will be deleted or anonymized in accordance with statutory retention periods.
The laws of the Republic of Austria shall apply, excluding the UN Convention on Contracts for the International Sale of Goods. The place of performance and exclusive jurisdiction for all disputes arising from or in connection with these terms is the registered office of Kalamata Transactions GmbH in Vienna. Should any provision of these terms be invalid, the validity of the remaining provisions shall remain unaffected.
